Against a hospital and multiple physicians in a medical malpractice action on behalf of a 52 year old man rendered paraplegic by a failure to diagnosis and treat a spinal infection (vertebral osteomyelitis) at T-8, T-9

For death of a 26 year old woman. This verdict was the highest verdict obtained in the state at the time for conscious pain and suffering.

Steve Levin

$3,000,000.00 Settlement

For an ironworker landing a joist who fell 14 feet from the top of a masonry wall because no fall protection was provided. Safety rules issued by the general contractor but unknown to their own superintendent, provided for six foot fall protection and man lifts for steel erection.

$1,950,000.00 Settlement

For an ironworker who fell 23 feet while dismantling temporary platforms without proper fall protection. Safety rules issued by the general contractor provided for six -foot fall protection and man lifts for steel erection.

$1,875,000.00 Settlement

For a union sheet metal worker who fell 26 feet from a school roof under construction. No perimeter protection for falls was provided by the general contractor in the fall hazard area and when workers attempted to nail two boards for minimal protection, they were stopped by the general contractor's superintendent.

$1,800,000.00 Settlement

Paid by the general contractor for a cell tower constructor who was fell 60 feet because he was provided hooks for fall protection that were too large for climbing pegs on the tower.

$1,200,000.00 Settlement

For a union ironworker who stumbled into a hole in a wooden mat placed down for workers to walk on to access the site. the holes in the timber mats were for crane grips but needed to be filled when used as a walkway.

$900,000.00 Settlement

For an ironworker who was injured separating steel for choking from a flatbed truck during a snowstorm. Steel delivered to the site had been unsafely cribbed so that workers had to separate steel using brute force on icy flatbeds. Paid by the general contractor and steel fabricator.


Adam Riback

$1,320,000.00 Settlement

Obtained for a 41 year old electrician that sustained a right knee injury due to a slip and fall on oil on the defendant's premises. Plaintiff was installing signs at the defendant's premises when he slipped on oil while dismounting his ladder. Plaintiff's right knee injury resulted in five surgeries and left him unable to return to work as an electrician. Plaintiff's medical bills were approximately $300,000.00. Plaintiff's employer agreed to a partial waiver of its worker's compensation lien that was in excess of $425,000.00 in addition to funding a Medicare Set Aside Trust for Plaintiff.

$1,000,000.00 Settlement

Obtained for a 24 year old ironworker that sustained a torn posterior cruciate ligament in his right knee when he slipped on ice, snow and hydraulic fluid located on metal decking at a construction site while attempting to install steel beams during the winter months. Plaintiff's injury ultimately required arthroscopic surgery and left him permanently disabled from the ironworker trade. Plaintiff's medical bills were approximately $95,000.00. Settlement included the complete waiver of a worker's compensation lien that was in excess of $300,000.00.

$1,000,000.00 Settlement (policy limits)

A 48 year old ironworker slipped and fell on oil left on the tile floor of a building where Plaintiff worked by defendant's truck. Defendant was performing work on a crane located on the premises of Plaintiff's employer. According to Plaintiff's treating surgeon, Plaintiff aggravated a pre-existing low back condition that required fusion surgery. Plaintiff's was unable to return to work as an ironworker as a result of his injuries and incurred medical bills of approximately $153,000.00.

$850,000.00 Settlement

A union bricklayer fell from a scaffold at a construction site, resulting in a herniated lumbar disc and a torn left rotator cuff and labrum. Plaintiff underwent surgery on both his low back and left shoulder. Plaintiff's medical bills were in excess of $215,000.00. Settlement included a full and complete waiver of a worker's compensation lien that was in excess of $442,000.00 and Plaintiff's employer agreeing to fund a Medicare Set Aside Trust Account.

$755,000.00 Settlement

A 42 year old ironworker sustained an injury to his neck and right vertebral artery while “shaking out” a piece of rebar from a pile of rebar on a construction site. Plaintiff underwent a two level cervical fusion and incurred medical bills in excess of $150,000.00. The settlement included the full and complete waiver of a worker's compensation lien in excess of $394,000.00.


Robert Adelman

$1,425,000.00 Settlement

A 42- year old sheet metal worker, sustained a herniated disk at L4-L5, L5-S1 requiring multiple surgeries.  This case had been previously rejected by a prominent Plaintiff's firm that handles construction litigation.

 

$855,932.00 Settlement

A 47 year old journeyman laborer from Local 269 sustained a torn meniscus in his left knee and an onset of grade IV chondromalacia requiring a high tibial osteotomy and application of an external fixator.

 

$460,000.00 Settlement

A 48 year old union laborer sustained a small left paracentral herniation at L5-S1 disk with impingement traversing left S1 nerve root and peripheral right sided herniation L3-L4 disk with bulging at L4-L5 requiring surgical repair.

 

$355,000.00 Settlement

A thirty-nine year old laborer and tile setter, sustained an anterior, posterior and superior glenoid labrum tear of the left shoulder from an automobile accident.

 

$250,000.00 Policy Limits Settlement

A forty-six year old residential painter with an un-operated left paracentral and lateral herniation at C5-C6 and C6-C7.

 

$250,000.00 Bench Verdict

An eleven year old boy, was playing at a friend's house when, without provocation, a pit bull dog viciously attacked him.  The minor suffered deep lacerations through the skin, fat, muscle down to bone on his right ankle and right tibia that required immediate surgery.

$237,500.00 Settlement

A sixty-nine year old woman with a right proximal humerus fracture (greater tuberosity fracture) and dislocation.  There was no wage loss and her medical bills were $57,000.00

 

$225,000.00 Settlement

A thirty-six year old security guard sustained a torn left Achilles tendon that required debridement and repair.  He also suffered a torn left meniscus that was surgically repaired.  Plaintiff had previously torn his Achilles. 

 

$150,000.00 Settlement

A forty-seven year old female passenger of a vehicle that was rear ended by a limousine suffered a right shoulder injury.  She elected to treat conservatively and never received surgery for her injuries.  She had $31,000 in medical bills and no wage loss.

 

$149,999.99 Settlement

A forty-eight year old female commercial cleaning lady sustained an aggravation of herniated disk at C5-6 and C6-7.  Her medical bills were approximately $11,000.00 and her wage loss was less than $20,000.00.

 

$59,157.85 Verdict

A seventy-one year old female passenger in a car that was sideswiped sustained a displaced base of the 5th metatarsal fracture, aggravation of  degenerative lumber disc disease, bruised ribs, rib and chest pain, left shoulder pain, neck, upper and lower back pain. 


 

Robert Domol

$750,000.00 Mediated Settlement

On behalf of a union sheet metal worker who suffered multiple devastating injuries when a temporary staircase collapsed beneath him at a residential home construction site. Rob and Steve Levin worked together on this case. Through depositions, they established that the general contractor's safety and supervisory personnel knew that vital support bracing was removed from the staircase before the collapse, but took no steps to make sure it was re-installed.

$155,000.00 Settlement

On behalf of a man who suffered a broken ankle requiring surgery after slipping and falling on ice outside of a residential apartment building. The ice formed as the result of a water main break, and the management company did not salt or adequately barricade it.

$100,000.00 Settlement

On behalf of a woman who suffered serious injuries to her cervical spine in a rear-end automobile accident.

$100,000.00 Policy Limits Settlement

On behalf of a man who suffered a ruptured biceps tendon in his dominant arm in a high speed collision on an area expressway.
